Terms and Conditions

Effective date: 7 September 2026

These Terms and Conditions govern your use of the Namandla Consultants website. By accessing or using this website, you agree to these terms. If you do not agree, please discontinue use of the website.

1. About Namandla Consultants

Namandla Consultants provides enterprise performance management, Oracle Hyperion, managed IT, enterprise data, infrastructure, cloud, networking and professional learning services. Information on this website is provided to explain our capabilities and help prospective clients decide whether to start a conversation with us.

2. Website information is not a binding proposal

Website content is general information and does not constitute a binding quotation, service-level agreement, professional opinion, guarantee or contractual commitment. Any engagement with Namandla Consultants is subject to a separate written proposal, scope of work, order form or services agreement signed by authorised representatives.

3. Acceptable use

You may use the website for lawful business and informational purposes. You may not attempt to gain unauthorised access to the website or its systems, introduce malicious code, interfere with availability, scrape the website in a manner that places an unreasonable burden on our systems, misrepresent your identity, or use the content to commit fraud or infringe another person’s rights.

4. Intellectual property

Unless otherwise stated, the website design, written content, graphics, branding, service descriptions and original materials are owned by or licensed to Namandla Consultants and are protected by applicable intellectual-property laws. You may view, download or print reasonable extracts for internal, non-commercial evaluation. You may not reproduce, republish, sell, modify or distribute substantial portions without prior written permission.

Third-party names, logos and trademarks remain the property of their respective owners. References to Oracle, Hyperion and other technology providers do not imply ownership of those marks or an endorsement beyond any expressly stated relationship.

5. Enquiries and communications

Submitting a contact form or sending an email does not create a client, advisory or support relationship. Please do not send passwords, production credentials, confidential datasets or other highly sensitive information through a general website form. We may use the details you provide to assess and respond to your enquiry in accordance with our Privacy Policy and applicable South African data-protection law.

6. Namandla Academy

6.1 Namandla Academy is our professional learning business. Course availability, accreditation references, catalogue size, pricing and access periods may change.

6.2 Every Academy purchase is governed by the Namandla Academy Course Terms, Cancellation and Refund Policy, as it stands on the date of your purchase. That policy sets out when access begins, how long it lasts, your cooling-off rights under the Electronic Communications and Transactions Act 25 of 2002, and the circumstances in which a course or subscription may be cancelled or refunded. Please read it before you buy.

6.3 Our courses are accredited for continuing professional development purposes by CPD Quality Standards in the United Kingdom. They are not South African qualifications, carry no NQF credits, and are not accredited by SAQA, a SETA or the QCTO. Completing a course does not guarantee employment, promotion, professional registration or any particular commercial outcome.

7. Third-party websites and services

The website may link to third-party platforms, publications, social networks, payment providers, learning systems or technology vendors. Namandla Consultants does not control those services and is not responsible for their availability, security, content or privacy practices. Accessing a third-party service is subject to that provider’s terms.

8. Accuracy and availability

We take reasonable care to keep website information useful and current, but we do not warrant that every statement is complete, error-free or continuously up to date. We may change, suspend or withdraw website content or functionality without notice. We do not guarantee uninterrupted or fault-free availability.

9. Limitation of liability

To the extent permitted by South African law, Namandla Consultants will not be liable for indirect, incidental, special or consequential loss arising solely from reliance on general website information or from an inability to access the website. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits rights granted by applicable consumer-protection legislation.

10. Privacy and cookies

10.1 What this section is

This section is our notification to you in terms of section 18 of the Protection of Personal Information Act 4 of 2013 (“POPIA”). It sets out what personal information we collect, why we collect it, who we share it with, how long we keep it and what you may do about it. It applies to your use of this website and to our dealings with clients, prospective clients, Academy learners and suppliers. There is no separate privacy document — this section is the notice.

10.2 Who is responsible for your personal information

Namandla Consultants (Pty) Ltd, registration number 2016/017981/07, is the responsible party for the personal information described in this section.
Address: 25 Massel Road, Beyerspark, Boksburg, Gauteng, 1459, South Africa
Telephone: 087 188 3388
Email: info@namandla.com

10.3 Our Information Officer

Our Information Officer is Juan Kaltwasser, Managing Director. Any privacy matter — including a request to access or correct your personal information, an objection to processing, or a complaint — should be directed to info@namandla.com or 087 188 3388, marked for the attention of the Information Officer.

10.4 The personal information we collect

Information you give us directly:
(a) when you complete an enquiry or contact form on this website: your name, email address, telephone number, organisation and the content of your message;
(b) when you correspond with us by email, telephone or in a meeting: the content of that correspondence and any notes we make of it;
(c) when you enrol in a Namandla Academy programme: your full name, email address, telephone number, employer and job role, the programme you enrol in, the lessons you access and the time you spend on them, your attendance and progress, your assessment responses and results, and the certification record produced on completion;
(d) when you engage us as a client or act as our supplier: the contracting, billing and banking details of your organisation, and the names, roles and contact details of the individuals we deal with.

Information we collect automatically when you use this website:
(e) your IP address, which is truncated so that it is not stored in full for analytics purposes;
(f) your browser type and version, operating system and device type;
(g) the page or search that referred you, the pages you view, and how long you spend on them;
(h) an approximate geographic location, no more precise than city level;
(i) information stored in or read from cookies, as described in 10.11 below.

Information we obtain from other sources:
(j) publicly available business information — company websites, public registers and professional networking profiles — where we research organisations we may wish to work with. We collect this about people in their professional capacity only.

We do not ask you for, and do not record, your race, your health or disability status, your religious or political beliefs, or your trade union membership. Our Academy does not enrol learners under the age of 18.

10.5 Why we process your personal information, and on what basis

(a) To respond to your enquiry and to prepare a proposal. Basis: steps taken at your request before entering into a contract, and our legitimate interest in answering people who contact us.
(b) To deliver our consulting, managed services and support engagements, and to manage the relationship. Basis: performance of our contract with you or your organisation.
(c) To deliver Academy training, assess your work, track your progress and issue your certificate, including submitting the learner and completion details our accreditation body requires. Basis: performance of our contract with you or your employer.
(d) To invoice, keep accounting records and meet our tax obligations. Basis: compliance with obligations under the Companies Act 71 of 2008 and the Tax Administration Act 28 of 2011.
(e) To operate, secure and improve this website, including measuring which pages are used. Basis: our legitimate interest in running a functional and secure website.
(f) To send service messages, and to send occasional information about our services to people at organisations we already work with or who have asked to hear from us. Basis: our legitimate interest, and consent where the law requires it. You may opt out of any marketing message at any time, at no cost, and we will act on that.
(g) To meet reporting obligations, including B-BBEE verification. Basis: compliance with a legal obligation.

10.6 Whether you have to give us your information

Everything you submit through this website is voluntary. If you do not give us your name and a way of reaching you, the only consequence is that we cannot respond to your enquiry.

Academy enrolment is different. Your name, contact details and assessment responses are mandatory, because we cannot register you on a programme, assess your work or issue a certificate in your name without them. We will tell you at the point of enrolment which fields are mandatory and why.

10.7 Who we share it with

We share personal information only where there is a reason to, and only to the extent needed:
(a) service providers who process it on our instruction and on our behalf, including our website host, email and cloud storage providers, and our analytics provider;
(b) associates and subcontractors engaged to deliver a specific engagement, each of whom is bound by written confidentiality obligations;
(c) our overseas learning-platform provider, located in the United Kingdom, which hosts the course content, operates the learning environment and provides tutor and learner support. Where you contact learner support, your enquiry and the account details needed to answer it are handled by that provider on our instruction;
(d) CPD Quality Standards (CPDQS), which accredits our Academy programmes, for the purpose of accreditation, quality assurance and certification;
(e) your employer, where your employer has sponsored, nominated or funded your participation in a programme. They will receive confirmation of your enrolment, your attendance and your outcome;
(f) our professional advisers, auditors and insurers, where reasonably required;
(g) a regulator, court or law enforcement authority, where we are legally obliged to disclose.

We do not sell your personal information, we do not rent or trade it, and we do not make it available to third parties for their own advertising.

10.8 Information sent outside South Africa

Some of the parties above are located or operate outside the Republic:
(a) CPD Quality Standards, which accredits our Academy programmes, is based in the United Kingdom. Where you complete an accredited programme, the learner and completion details needed for certification are shared with them in the United Kingdom;
(b) our learning-platform and tutor-support provider is based in the United Kingdom. Your account details, course activity and any support enquiry you raise are processed there;
(c) Google, which provides our website analytics, operates internationally;
(d) our hosting, email and cloud storage providers may store or process information outside South Africa.

Where personal information is transferred outside South Africa we do so only on a basis permitted by section 72 of POPIA: because the recipient is subject to a law, binding corporate rules or a binding agreement that provides an adequate level of protection substantially similar to POPIA; because the transfer is necessary to perform a contract with you, or to conclude or perform a contract concluded in your interest; or with your consent.

In the case of the United Kingdom, the UK General Data Protection Regulation and the Data Protection Act 2018 provide a level of protection substantially similar to POPIA, and the transfers described in (a) and (b) are in any event necessary to deliver the course and the accredited certification you enrolled for.

10.9 How long we keep it

(a) Enquiries that do not lead to an engagement: 24 months from your last contact with us, after which they are deleted.
(b) Client engagement records, including correspondence and deliverables: 5 years after the engagement ends, unless a longer period is required by law or by the terms of that engagement.
(c) Accounting, invoicing and tax records: 5 years, as required by the Companies Act and the Tax Administration Act.
(d) Academy assessment records and course activity: 3 years after you complete or withdraw from a programme.
(e) Academy certification records — your name, the programme completed and the date: retained indefinitely, so that we can verify your achievement if you or a prospective employer asks us to. If you would prefer us not to keep this record, tell us and we will discuss what we can do without compromising a verification you may later need.
(f) Website analytics: for the retention period configured in our Google Analytics property, after which it is deleted by Google.

Where we no longer have a lawful reason to keep your information, we delete it or de-identify it.

10.10 How we protect it

We take the security measures that are reasonably practicable for a business of our size and nature. These include encryption of traffic to and from this website using TLS, access controls and multi-factor authentication on the systems that hold personal information, keeping software and plugins patched, restricting access to those who need it, and maintaining backups.

No system is perfectly secure. If a security compromise affects your personal information, we will notify you and the Information Regulator as required by section 22 of POPIA, as soon as reasonably possible after establishing what has happened.

10.11 Cookies

A cookie is a small file placed on your device by a website. This site uses the following categories:
(a) Strictly necessary cookies, which are required for the site to work — they manage your session, support security, and allow our page caching to serve you the correct version of a page. The site cannot function properly without these.
(b) Analytics cookies, set by Google Analytics, which tell us how many people visit, which pages they read and how they arrived. We have configured Google Analytics to anonymise IP addresses, and we do not use it to build advertising profiles.
(c) Preference cookies, which remember choices you make so you are not asked again.

You can block or delete cookies through your browser settings — every major browser allows this, usually under Privacy or Site Settings. If you block strictly necessary cookies, parts of this website may not work.

10.12 Your rights

Under POPIA you have the right to:
(a) be told whether we hold personal information about you, and to request a copy of it. A request for access is made under the Promotion of Access to Information Act 2 of 2000, and a prescribed fee may apply;
(b) ask us to correct or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully;
(c) object, on reasonable grounds, to our processing of your personal information where we rely on legitimate interest;
(d) withdraw your consent at any time, where we rely on your consent. Withdrawing consent does not affect processing that already took place;
(e) opt out of direct marketing at any time, at no cost;
(f) not be subject to a decision affecting you that is based solely on automated processing.

To exercise any of these, contact our Information Officer at info@namandla.com, marking your message for their attention. We will respond within a reasonable period, and in any event within the period the law requires. We may need to verify your identity first.

10.13 Complaints

If you are unhappy with how we have handled your personal information, please raise it with our Information Officer first — most matters are resolved quickly that way. You also have the right to complain directly to the Information Regulator at any time:

The Information Regulator (South Africa)
Woodmead North Office Park, 54 Maxwell Drive, Woodmead, Johannesburg, 2191
Toll free: 0800 017 160
Telephone: 010 023 5200
General enquiries: enquiries@inforegulator.org.za
POPIA complaints: POPIAComplaints@inforegulator.org.za
PAIA complaints: PAIAComplaints@inforegulator.org.za

A complaint to the Regulator is lodged on the prescribed POPIA/PAIA Form 5.

10.14 Changes to this section

We may update this section as our services or the law change. The version in force is the one published on this page. Where a change materially affects how we handle your personal information, we will say so on this page.

Last updated: 7 September 2026

11. Security

We apply reasonable safeguards to the website, but no internet service is completely secure. You are responsible for using current security software and appropriate precautions when accessing online services. If you identify a suspected security vulnerability affecting this website, please report it responsibly to info@namandla.com and do not publicly disclose it before we have had a reasonable opportunity to investigate.

12. Changes to these terms

We may update these Terms and Conditions when the website, our services or applicable legal requirements change. The effective date at the top of this page indicates the latest revision. Continued use of the website after an update constitutes acceptance of the revised terms.

13. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute relating exclusively to use of this website will be subject to the jurisdiction of the competent South African courts, subject to any mandatory dispute-resolution rights that apply by law.

14. Contact

General questions about these terms may be sent to info@namandla.com or 087 188 3388.

Privacy matters — including requests to access or correct your personal information, objections to processing, opt-out requests and complaints — should be sent to our Information Officer, Juan Kaltwasser, at info@namandla.com. Please mark your message “POPIA request” so that we route it correctly and respond within the required period.
